experience

• Representing a client from the paper industry in an arbitration case worth about PLN 200 million (EUR 46 million) concerning options to acquire shares and take control of an SPV operating a heat and power plant, leading to issuance of an arbitration award in the client’s favour and conclusion of a comprehensive settlement between the parties

• Advising a client from the insurance industry in a dispute concerning damages for injury caused by a fire at a shopping centre (amount in dispute over PLN 25 million/EUR 7.5 million), including a case in the state court dismissed due to the defence of an arbitration clause, reaching the Supreme Court of Poland, and subsequently ICC arbitration leading to a settlement during the proceeding

• Representing a legal services firm in a dispute with a partner over exclusion from the firm, including arbitration and post-arbitration proceedings, leading to settlement during the court proceedings

• Representing a general contractor in a dispute with the investor concerning allegations of defective performance of construction work on a residential building, including repayment of amounts drawn under a bank guarantee, leading to a settlement in the course of arbitration proceedings

• Representing an industrial client in a dispute for payment under a joint-venture agreement (c. USD 30 million) under the UNCITRAL arbitration rules with the place of arbitration in New Delhi, leading to a settlement in the course of the arbitration

• Representing a retail client (chain of building-supply supermarkets) sued by a US-based investment fund managed by one of the largest private equity firms in the CEE region for c. PLN 12.5 million, concerning preliminary and final share sale agreements

• Advising on a dispute over repayment of a loan for c. PLN 4.5 million made by our client to a potential partner planning to participate in the purchase of a manufacturing facility in southern Poland, including the liability of a member of the company’s management board for the unsatisfied claim; in addition to a guarantor’s liability, the dispute also involved setting aside a transfer of property by the guarantor to the detriment of the creditor; all the matters were concluded in a settlement among all entities, favourable to the client

• Representing a local government cultural institution (public entity) in three judicial proceedings worth a total of about PLN 800,000 initiated by two advertising companies alleging unjust enrichment following the delivery of advertising services; all the cases ended in final judgments denying the claims against the client

• Ongoing advice on payment services, corporate law and disputes for one of the largest electronic payment companies in Poland

• Advising on labelling of packaging and advertising of products

• Advising a client from the construction industry (window manufacturer) on CE marking

• Advising a client from the residential construction industry in current matters involving guarantee claims under several construction contracts for a large Warsaw residential cooperative
